¶ 1. Lucien Agnello appeals a judgment of conviction for first-degree intentional homicide, party to a crime. The issues are: (1) whether Agnello's confession was voluntary and therefore admissible; and (2) if we affirm the trial court's ruling that the confession was voluntary, whether Agnello was *264entitled to a trial because of the Wisconsin Supreme Court's vacation of his original conviction. We conclude the trial court correctly decided his confession was voluntary. We also conclude that Agnello is entitled to a trial.
