HELLENTHAL, District Judge.
The petitioner alleges that on the 14th day of September, 1934, a restaurant beer and wine license was issued to R. Naka, under Section 2 of Chapter 71, Session Laws of Alaska for 1933; that R. Naka is a subject of the Empire of Japan, and is not a citizen of the United States of Ameri*3ca; that said license was issued and is in violation of Section 1 of said act; and prays that an order to show cause be issued requiring said R. Naka to show cause, if any, why said license should not be revoked, and for other and further relief.
