I. INTRODUCTION
In July 2002, plaintiffs Susan Hallock and Ferncliff Associates, Inc. (collectively “plaintiffs”) brought an action against the United States under the Federal Tort Claims Act. The defendant’s motion to dismiss was granted, on the basis of an exception to the Act’s waiver of sovereign immunity. Hallock v. United States, 253 F.Supp.2d 361 (N.D.N.Y.2003).
