The appellant — defendant below — was indicted by a grand jury at the October term of the district court for Wabaunsee county, for the year 1884, for selling intoxicating liquors in violation of the prohibitory liquor law. At that time Wabaunsee county was a part of the third judicial district, which then embraced the counties of Shawnee, Pottawatomie, Riley, and Wabaunsee.
