The judgment that is here under review is the result of the second trial of the action. Upon the first trial there was a verdict in favor of the plaintiff, which was set aside hy the Supreme Court, on rule to show cause, for reasons expressed in an opinion delivered by Mr. Justice Parker, and reported in 51 Vroom 163. Upon the second trial this decision was deemed by the trial judge to be controlling, and he granted a nonsuit. This ruling, to which an exception was duly sealed, is now assigned for error.
