BUSSEY, Presiding Judge:

Richard Carwile, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Muskogee County for the offense of Murder; his punishment was fixed at life imprisonment, and from said judgment and sentence, a timely appeal has been perfected to this Court.

Briefly stated, the evidence at the trial adduced that Cornelia Griffin resided at 415 Kenny Street in Muskogee, Oklahoma. She testified that at approximately 2:00 or 3:00 on the afternoon of December 2, 1969 (from the other witness’s testimony, December 1, 1969, was the correct…
