Claimant Barry Bates petitions for review of the order of the Workers’ Compensation Appeal Board (Board), affirming the decision of a Workers’ Compensation Judge (WCJ), which, inter alia, granted claimant’s penalty petition against employer, Titan Construction Staffing, LLC and its workers’ compensation insurer, the State Workers’ Insurance Fund (SWIF),2 but denied counsel fees based upon a finding that employer’s contest of the penalty petition was reasonable.
