A. The Federal Election Commission's Enforcement Authority

The Federal Election Commission is an agency that "administer[s], seek[s] to obtain compliance with, and formulate[s] policy with respect to" the Federal Election Campaign Act (the Act), and has "exclusive jurisdiction with respect to the civil enforcement of such provisions." 52 U.S.C. § 30106(b)(1). The Commission comprises "6 members appointed by the President, by and with the advice and consent of the Senate." Id. § 30106(a)(1).
