MATHES, District Judge.
This is an action for injunctive relief and damages grounded upon alleged infringement of an unregistered trademark, “Fairy Princess”, used in connection with plaintiff’s product on certain unusual containers designed to hold bubble bath, lotion, cologne, and the like.
Plaintiff’s original complaint, invoking the jurisdiction of this Court under §§ 43(a) and 44(f) of the Lanham Act [15 U.S.C.A. §§ 1125(a) and 1126 (f) ], was dismissed for lack of jurisdiction over the subject matter, inasmuch as that Act does not confer upon the Federal courts jurisdiction over “naked”…
