1. We will deal with the order denying the motion by the transfer company to arrest and set aside the verdict and judgment for $10,000 in favor of Gabriel, and the order and judgment refusing to set aside the verdict and judgment in favor of Malone for $15,000. Both of these findings of the jury and the judgment entered thereon were against the transfer company, plaintiff in error here, and the grounds of attack made by it upon them are the same. It is urged that, while Malone did not sue the driver of its tractor along with the transfer company, although Gabriel did seek to join the driver…
