Mrs. Nix brought a joint action against the Southern Railway Company, Will West and John Mann, the engineer and fireman, respectively, of the company, to recover damages for the homicide of her husband. The trial resulted in a verdict for the plaintiff against the company alone, which in effect was a finding that the engineer and fireman were not liable. The court entered judgment against the company for the amount of the verdict, and a judgment in favor of the other two defendants for the costs incurred by their having been made parties to the suit.
