The appellant commenced a suit against the respondents, James A. A. Wilson and Susannah Wilson, in the court below, to foreclose a mortgage upon real property given to secure the payment of two certain notes executed by the said James A. A. Wilson to the appellant, on the thirtieth day of November, 1875. One of the notes was for one thousand dollars, due one year from date, the other for two thousand dollars, and due three years from date. Each of them to draw one per cent per month interest.
