The appellee was plaintiff in the court below and appellant the defendant. The plaintiff brought suit for a personal injury, alleged to be inflicted upon him by an unruly team of oxen, which were furnished by the team foreman of the appellant for the performance of the work which the plaintiff was engaged in. The work being done at the time of the injury was the grading or repairing of a railroad track of the appellant.
