Appeal from a judgment of the Supreme Court at Trial Term (Ellison, J.), rendered June 10, 1982 in Chemung County, upon a verdict convicting defendant of the crimes of rape in the first degree, aggravated sexual abuse and burglary in the first degree. Defendant was indicted for rape in the first degree, aggravated sexual abuse and burglary in the first degree. These charges stem from an incident which, presenting the facts most favorable to the People in the light of the conviction (see People v Kennedy, 47 NY2d 196, 203), occurred in the early morning hours of Sunday, September 20, 1981.…
