Appeal from a judgment of the County Court of Rensselaer County (Ceresia, Jr., J.), rendered September 22, 1989, upon a verdict convicting defendant of the crimes of burglary in the first degree (two counts), rape in the first degree, robbery in the second degree and sexual abuse in the first degree.

Defendant was indicted in January 1988 on two counts of burglary in the first degree, rape in the first degree, robbery in the second degree, attempted sodomy in the first degree and sexual abuse in the first degree. The charges contained in the indictment stemmed from a December 4, 1987 incident…
