sitting in place of MR. JUSTICE MATTHEWS, disqualified, delivered the opinion of the court.

This is an appeal from a final judgment and decree of the district court of' Broadwater county in favor of the plain tiff, Jefferson D. Doggett, and against the defendant John H. Johnson, made and entered on the eleventh day of March, 1927, quieting title in the plaintiff to the real estate in controversy in the action and decreeing possession thereof.
