Tbe plaintiff in error, Folds, wbo is confined in tbe Fort Pillow State Penitentiary, filed a petition for writ of habeas corpus alleging tbat be is illegally restrained of bis liberty. Tbe Trial Judge issued tbe writ and ap*197pointed counsel to represent the petitioner. The cause was heard in the Trial Court on the petition for writ of habeas corpus, the answer and amended answer of the respondent, and oral testimony introduced in open court. After full hearing, the Trial Judge dismissed the petition by order in which the Court, among other things, found “that…
