The plaintiff, Jennifer D., brings this action on behalf of her son Travis D. (“Travis”) pursuant to the Individuals with Disabilities in Education Act (“IDEA”), 20 U.S.C. §§ 1400 et seq., against the New York City Department of Education (the “DOE”). The plaintiff is appealing from an order of the State Review Officer (“SRO”), that declined to award her tuition reimbursement for her unilateral placement of Travis in the Legacy Program at Xaverian High School (the “Legacy Program”) for the 2006-07 school year.
