HAMILTON, District Judge.

This matter is pending before the court on the motion of the Farmers Bank & Trust Company, trustee in bankruptcy of the above-named bankrupt in a former proceeding, and of Mrs. Tommie R. King and Marion D. Eblen, receiver of Henderson National Bank, creditors, to dismiss this action, and on the exceptions of the Farmers Bank & Trust Company, trustee, to. the report of the conciliation commissioner.
