This suit was brought by appellee against appellant to recover the value of a diamond ring, the separate property of plaintiff’s wife, alleged to have been dropped by her while a passenger on one of defendant’s cars en route from San Antonio to Dallas, Texas, and to have been found by its porter and appropriated to his own use. The value of the ring was averred to be $1,500, which was the amount sued for. The defendant answered by a general and a special exception to the petition and a general denial.
