In a mandamus proceeding instituted in the court below, the defendant in error, State ex rel. Ocala Brick & Tile Company, sought to compel the respondents in the court below, as members of ■ the Board of County Commissioners of Sumter County, Florida, and the Clerk of said Board, to pay certain due bills or certificates of indebtedness of Sumter County, Florida, from certain moneys held by the Board of County Commissioners and alleged to be applicable to the payment of such items.
