I. Introduction

A jury found Appellant Brian Douglas Barnstein guilty of criminal mischief for shooting and killing a Hereford bull worth more than $1,500. See Tex. Penal Code Ann. § 28.03(b)(4)(A) (Vernon Supp. 2005). The jury assessed Barnstein’s punishment at 180 days’ confinement and a $1,500 fine, and the trial court sentenced him accordingly.…
