Plaintiff, upon the expiration of his term of Army enlistment, was honorably discharged as a Sergeant on December 10,1958. He was at that time determined to be physically fit for duty. In this suit he contends that on such date he was, in fact, unfit for duty by reason of permanent disabilities and therefore eligible for disability retirement pay.
