MEMORANDUM OPINION AND ORDER
BABCOCK, District Judge.
Defendants Colorado Permanente Medical Group, P.C. (CPMG or Kaiser) and Dr. Suzanne Simmons-McNitt (Dr. McNitt)(arbitration defendants) move to dismiss the complaint of plaintiffs Roger A Morrison (Mr. Morrison), Donald Evig (D.Evig), and Patricia Evig (P.Evig) (collectively, plaintiffs) pur suant to Fed.R.Civ.P. 12(b)(1) for lack of jurisdiction over the subject matter.
