The government appeals in a proper and timely manner pursuant to D.C. Code 1973, § 23-104(a)(l) the trial court’s grant of appellees’ motion to suppress statements and physical evidence which appellees contended were the fruit of an unlawful arrest.
On October 7,1976, at approximately 9:40 p.m. officers Steven Beach and Bernardo Garcia drove their scout car into one end of an alley behind the 3800 block of Kansas Avenue, N.
