VAN VALKENBURGH, Circuit Judge.
Appellant sued in the circuit court of Jackson county, Mo., to recover on a policy of insurance issued by respondent to her husband, Samuel C. Hawthorne, July 3, 1918. The insured died March 27, 1930. The ease was removed to the District Court of the United States for the Western District of Missouri. A jury was waived by stipulation, and the ease was tried to the court. The following judgment was entered:
