BERRY, Justice.
In this action William E. Lenox, hereafter referred to as “plaintiff”, sought to recover commissions allegedly earned in writing insurance policies issued by defendant in error, Old Republic Credit Life Insurance Company, hereafter referred to as “Old Republic”, which commissions plaintiff alleged were wrongfully paid to defendant in error, United Finance and Thrift Corporation, hereafter referred to as “United”.
