ANDERSON, Circuit Judge.

This is an appeal from a final order of the District Court for the Southern District of New York granting a motion for summary judgment made by the defendant Cities Service Co. and denying the plaintiff Waldron’s 1 motion under F.R.Civ.P. 56(b) for further discovery. Cities Service was one of seven major oil companies named as defendants in this treble damages action brought on June 11, 1956 pursuant to § 4 of the Clayton Act, 15 U.S.C. § 15 (1964 ed.).
