Thomas Beirne and James Beirne (“Beirne”) operate a gasoline service station at 606 Wantagh Avenue, Levittown, Nassau County, New York, under the tradename “Getty” pursuant to a lease and supply agreement dated May 23, 1984, which expired November 30, 1987. 1 Beirne moved (order to show cause dated May 9, 1988) for a preliminary injunction pursuant to Fed.R.Civ.P. 65 to enjoin the threatened termination by defendant Getty Petroleum Corp.
