It is plaintiff’s claim, in this action which was filed in the United States District Court for the Southern District of New York more than eight years ago, that defendants Teachers Insurance and Annuity Association (“TIAA”) and College Retirement Equities Fund (“CREF”) have violated the equal employment provisions of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (“Title VII”), by using sex-based mortality tables to calculate the benefits to which pension plan participants, including plaintiff, are entitled upon retirement.
