This matter is before the court on plaintiffs motion for summary judgment.

I. Background

Plaintiff Thrifty Rent-A-Car System, Inc. (“Thrifty Renb-A-Car”) brought this action against defendant Thrifty Auto Sales of Charleston, Inc. (“Thrifty Auto”), pursuant to the United States Trademark Act, or Lan-ham Act, 15 U.S.C. § 1051 et seq., and the common law of South Carolina.
