Pending before the Court is the defendants’, BP Exploration and Production Inc., BP America Inc., BP p.l.c., and BP Products North America Inc. (collectively, “BP”), motion to dismiss the plaintiffs’ amended complaint pursuant to Federal Rules of Civil Procedure 12(b)(6), 9(b), and 12(b)(7) (Docket Entry No. 56).
