This action is in assumpsit upon a contract of fire insurance alleged to have been entered into November 26, 1930, by the plaintiff, Giacinto Rossi, and the defendant, Firemen’s Insurance Company of Newark, New Jersey, covering plaintiff’s residence in the Borough of Johnsonburg, Elk County, and the furniture and household goods therein. This property was totally destroyed by fire on November 27, 1930, but defendant refused to pay any part of the loss, claiming that no such contract existed.
