In this appeal the parties are in the same relative position as in the trial court and will be hereafter referred to as plaintiff and defendants.

The cause proceeded to trial upon plaintiff’s amended petition, filed on April 15, 1932. Therein plaintiff alleged, in substance, the following:

That plaintiff is the owner of an undivided two-thirds of certain lands by inheritance from Louis Harjo and his heirs. The land in controversy was allotted to Louis Harjo, a full-blood Seminole Indian, who was the son of Oche and Judy Harjo. Oche Harjo died intestate prior to allotment, leaving…
