Action in the district court for St. Louis county, by plaintiff, as administrator of the estate of Leslie J. Craig, deceased, to recover $5,000 for tlie death of decedent. The case was tried before Ensign, J., and a jury, which rendered a verdict in favor of defendant. From an order denying a motion for a new trial, plaintiff appealed.

Action to recover damages for the death of plaintiff’s intestate, caused, as he alleges, by the negligence of defendant. Defendant had a verdict in the court below, and plaintiff appealed from an order denying his motion for a new trial.

The facts in the case are substantially as follows: Defendant is a corporation organized under the provisions of G.
