OPINION

BUTTS, Justice.

After appellant’s conviction by a jury for the offense of conspiracy to commit murder, TEX.PENAL CODE ANN. § 15.02 (Vernon 1974), the court assessed punishment at 20 years’ imprisonment and a fine of $10,000.00.

In his first point of error appellant maintains his motion for instructed verdict should have been granted because the indictment against him charged conspiracy to commit murder, but the coconspirator was convicted of voluntary manslaughter.
