State v. Diaz-Bonilla
Court of Appeals of Texas
1Opinion of the Court
OPINION
Tracy Christopher, Justice
Pastor Israel Diaz-Bonilla (“Diaz”) pleaded guilty to engaging in organized criminal activity. He then moved fon a new trial, arguing that his counsel had given him erroneous advice, which rendered his plea involuntary. Following an evidentiary hearing, the trial court deter*48mined that counsel’s assistance had been ineffective, and it signed an order granting the motion for new trial. The State now appeals from that order. Finding no abuse of discretion, we affirm the trial court’s decision.
