OPINION

NESBETT, Chief Justice.

Petitioner, a resident of Fairbanks, filed a complaint for divorce in the Superior Court for the Fourth Judicial District at Fairbanks, on August IS, 1966. Petitioner alleges that pursuant to an agreement with his wife, respondent herein, that she would accept service and waive a summons, he mailed a copy of the as yet unfiled complaint to her on August 10, 1966. Summons was issued in Fairbanks on August 18, 1966, and forwarded to the State Police in Anchorage where it was received on August 19, 1966.
