Plaintiff James W. Moeller is an energy lawyer in his late fifties who has applied for several attorney' positions at the Federal Energy Regulatory Commission (“FERC”). He has- been neither hired nor interviewed, and he brought this lawsuit against the Acting Chairman of FERC, Cheryl A.
