This is an appeal from an action in the district court of Bryan county, Okla., between C. Z. Houghton, commonly called Joe, and A. M. Houghton, called Alvin, over certain business property in the city of Durant. Joe, the plaintiff, won, and Alvin has appealed.

The first assignment of errors argued relates to a motion and demurrer filed to the petition. This upon the theory that the petition failed to comply with section 592, O.
