This matter arises on Defendant Minnesota Life Insurance Company’s and Defendant Standard Insurance Company’s (“Defendants” or “Minnesota Life”) Motion For Summary Judgment on ERISA 1 preemption issues (doc. # 95), filed on May 13, 2005. Defendants contend that there are no genuine issues of fact that the subject insurance policy is part of an “employee welfare benefit plan” and, therefore, ERISA preempts all of Plaintiffs’ state law claims.
