MEMORANDUM OPINION AND ORDER

ALBRITTON, Chief Judge.

This matter comes before the court on a Motion for Summary Judgment filed by Defendants City of Tallassee and Officer Bill Royal (“Royal”) on April 2, 2001 (doc. #22). Plaintiff Vanessa Babers (“Plaintiff’) filed her complaint on August 30, 2000, bringing claims for violation of 42 U.S.C. § 1983 (Count I), for false arrest and imprisonment (Count II), and for malicious prosecution (Count III).
