Hershel Radio Company, a copartnership, plaintiff, brought suit against the Pennsylvania Railroad Company, a Pennsylvania corporation, ’ defendant, and the Southern Pacific Railroad Company, codefendant. Upon dismissal of the case against the codefendant (Hershel Radio Company v.
