MEMORANDUM OPINION AND ORDER
LOZANO, District Judge.
This matter is before the Court on Defendants’ Motion to Dismiss and for Summary Judgment, filed January 6, 1994. For the reasons set forth herein, this Motion is GRANTED IN PART and DENIED IN PART. Also pending before this Court is Plaintiffs’ Motion to Strike the Declaration of James M. Verdier. For the reasons set forth herein, this Motion is DENIED. BACKGROUND
