This case is before the court on Defendant’s motion to dismiss or in the alternative for summary judgment.

FACTS

This action involves a contract between Plaintiff Management Science America (“MSA”), a developer and manufacturer of computer software, and the Department of Housing and Urban Development (“HUD”), an agency of the United States Government. Under the contract, MSA was to install, demonstrate and test a package of accounting systems software for HUD’s IMB and Sperry computer systems.
