This is a trade dress infringement, commercial misrepresentation, and unfair competition action. Plaintiff Western Chemical Pumps, Inc. (“Western”) contends that defendants Superior Manufacturing, Inc. (“Superior”) and Alan H. Hulva infringed the trade dress of two of Western’s chemical injection pumps in violation of the Lanham Act, particularly 15 U.S.C. § 1125(a).
