HORAN, J.,

— Before the court for consideration is motorist’s license suspension appeal from the Commonwealth of Pennsylvania Department of Transportation’s notice of suspension under 75 Pa.C.S. *286§ 1547(b) for refusal to submit to chemical testing. Hearing on this appeal was held on May 4, 1995. For the reasons which follow, said appeal is dismissed.

The pertinent facts of the case are as follows:
