OPINION ON DEFENDANTS’ MOTION TO DISMISS AND PLAINTIFF’S CROSS-MOTION FOR LEAVE TO AMEND
BROTMAN, District Judge.
Presently before the Court are the (1) motion by Defendant Falasca Mechanical Contractors, Inc. (“Falasca”) to dismiss Counts' I, II and V of the Amended Complaint, in which defendants Iannacone Contracting Company, Inc. (“Iannacone”) and Buena Plumbing, Inc. (“Buena”) join, and (2) Plaintiffs cross-motion for leave to file a second amended complaint. For the reasons stated below, Counts I, II and V of the Amended Complaint will be dismissed without prejudice against defendants…
