ALARCON, Circuit Judge:
This is an appeal from a judgment dismissing with prejudice the plaintiff’s claims under the federal Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. *1395§§ 1961-1968 (1982) (hereinafter RICO). We must decide whether the district court erred in dismissing the RICO claims and abused its discretion in failing to grant plaintiff leave to amend the complaint. We reverse and remand with instructions.
