This appeal is taken from a decree of the Circuit Court of Baltimore City sustaining a demurrer to the plaintiff’s bill of complaint, and dismissing the bill. The bill alleges that the plaintiff, Alexander Y. Dolfield, is the owner of a parcel of land now within the limits of Baltimore City and along the line of the Western Maryland Railroad Company, which will be designated herein as the Railroad Company. That said Railroad Company is a corporation under certain special acts of the General Assembly of Maryland with authority to construct, repair and operate a railroad between certain points…
